Community Fundraising Agreement (Waiver, Authority & Terms)

1. Purpose of Agreement

I wish to fundraise for Ronald McDonald House Greater Western Sydney ("Ronald McDonald House GWS"). This agreement applies to my fundraising activity ("Event") and any related activities undertaken to raise funds for Ronald McDonald House GWS.

By signing this document, I acknowledge that it forms the full agreement governing my fundraising activities, including authority to fundraise, responsibilities, and legal waivers.

2. Authority to Fundraise

I understand that I am not authorised to use the name, logo, or represent Ronald McDonald House GWS as a beneficiary charity until I have received written approval ("Authority to Fundraise").

Ronald McDonald House GWS may grant authority at its discretion once it is satisfied that:

• The Event aligns with the mission, vision, and values of Ronald McDonald House GWS;
• The Event is not considered high risk;
• The Event is expected to generate a reasonable return after expenses.

Ronald McDonald House GWS reserves the right to refuse, withdraw, or terminate authority at any time, with or without cause. Upon withdrawal, I agree to immediately cease the Event and all use of Ronald McDonald House GWS branding.

3. Responsibilities of the Fundraiser

I acknowledge that:

• I am fully responsible for the planning, coordination, and delivery of my Event;
• Ronald McDonald House GWS does not provide event management, staffing, goods, or services;
• Ronald McDonald House GWS does not provide legal, financial, or compliance advice;
• All activities must comply with relevant laws, regulations, and licensing requirements.

If I am under 18 years of age, I confirm that I have obtained guardian approval.

4. Risk, Safety and Insurance

I acknowledge that:

• My participation in the Event is voluntary;
• I assume all risks associated with organising and participating in the Event;
• Ronald McDonald House GWS does not provide insurance, including public liability insurance;
• I am responsible for arranging any necessary insurance and safety measures;
• I am responsible for ensuring appropriate medical planning and support where required.

I confirm that I am physically and medically capable of participating in the Event and am not aware of any condition that may put me or others at risk.

5. Indemnity and Release

I agree to release, indemnify and hold harmless Ronald McDonald House GWS, any beneficiaries, sponsors, officials, participating clubs, communities, organisations, friends of the Event, volunteers, consultants, participants, third-party vendors, government or public entities) and each of their respective affiliates, successors, officers, directors, employees, volunteers, agents, and representatives, including, without limitation, Event medical sponsors, medical director, and members of the medical team from all claims, actions, demands, suits or proceedings of any nature whatsoever which may be made by me, on my behalf, or by or on behalf of any other person, in respect of or arising out of any liability, loss, cost, damage or expense, including but not limited to damage to property, injury or death, that I or any other person suffer during the course of, as a result of, or that is associated with, the Event, (including during any preparation or planning for the Event or any associated activity), and however caused (whether due to the negligence or omission of Ronald McDonald House GWS, its officials, employees, agents, contractors, volunteers or other personnel, or otherwise).

6. Fundraising Conduct and Restrictions

I agree that my Event:

• Must align with the values and reputation of Ronald McDonald House GWS;
• Must not be illegal, unsafe, or unethical;
• Must not involve:
• Gambling or unlawful games of chance;
• Extreme or high-risk activities;
• Activities of a sexual nature;
• Activities that promote harm to individuals, animals, or the environment.
• Motor vehicle and motor bike racing and activities that involve marine racing unless I provide evidence of public liability insurance to cover myself and my participants

Ronald McDonald House GWS may decline or prohibit any Event at its discretion.

7. Branding and Promotion

I acknowledge that:

• All use of the Ronald McDonald House GWS name, logo, or materials requires prior written approval;
• All promotional materials (including media releases, social media, and printed items) must be approved before publication;
• I must not imply that Ronald McDonald House GWS is organising or sponsoring the Event.

8. Financial Management and Reporting

I acknowledge that:

• I am solely responsible for all financial aspects of the Event;
• I must maintain accurate financial records;
• Expenses must be reasonable and should not exceed 40% of total proceeds;
• Funds raised must be remitted to Ronald McDonald House GWS within four (4) weeks of the Event;
• Ronald McDonald House GWS cannot cover or reimburse expenses;
• A separate bank account may be required where appropriate.

I understand that:

• Tax-deductible receipts can only be issued by Ronald McDonald House GWS for eligible donations of $2 or more;
• I must keep records of donors requiring receipts;
• The following are not tax-deductible:
• Event tickets or entry fees;
• Raffle tickets;
• Auction purchases;
• Donations of goods or services.

9. Participation and Conduct

I acknowledge that my participation in the Event is subject to the discretion of Ronald McDonald House GWS, and I may be restricted or removed at any time.

10. Media Consent

I consent to the use of my name, image, voice, and likeness in photographs, videos, or recordings taken in connection with the Event for promotional purposes by Ronald McDonald House GWS, without compensation.

I waive any rights to approve or inspect such materials.

11. General

• I confirm that I am not relying on any representation by Roanld McDonald House GWS in organising my Event;
• This agreement is binding on me and my heirs, executors, and legal representatives;
• This agreement is governed by the laws of New South Wales;
• Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales.

12. Declaration

I confirm that I have read and understood this agreement and agree to be bound by its terms.
